Product Sales; Online Orders

5.1 Offer and Acceptance. Any order you place is an offer to buy the products listed in your order. We may accept or reject any order at our discretion, including for pricing or availability errors. We will not be obligated to supply products until we confirm acceptance (e.g., order confirmation or shipment notice).

5.2 Pricing and Errors. Prices and promotions are subject to change without notice. We may cancel orders arising from typographical or system errors even after confirmation, with a prompt refund of any amounts paid. Taxes and shipping are additional unless stated otherwise.

5.3 Availability; Substitutions. Availability may be limited. We may offer functionally equivalent substitutions upon your approval.

5.4 Fitment, Load, and Speed Ratings. You are solely responsible for selecting products appropriate for your vehicle, use case, load, speed rating, terrain, and applicable laws. Always verify tire size, offset, load index, speed rating, and vehicle clearances.

5.5 Professional Installation Required. Tires must be installed, mounted, and balanced by qualified professionals using appropriate tools, supplies, and safety equipment. Follow torque specifications and re-torque after 25–50 miles or as recommended by your installer. Improper installation can cause serious injury or death.

5.6 Off-Road and Specialty Use. Some products are designed for off-road or competition use and may not be legal on public roads. You are responsible for compliance with all applicable laws and regulations.

5.7 Risk of Loss; Title. Unless otherwise stated in your order, risk of loss passes to you upon our delivery to the carrier. Title passes upon your full payment.

5.8 Returns; RMAs. Returns, if permitted, require a return merchandise authorization (RMA) and must comply with our then-current Return Policy at founderstires.com/shipping-returns.html. Products must be unused, unmounted, and in resalable condition unless defective. Shipping charges are non-refundable unless required by law.

5.9 Warranties. Products are covered, if at all, by the manufacturer’s written warranty accompanying the product or posted at founderstires.com/warranty.html. To the maximum extent permitted by law, we disclaim all other warranties for products sold via the Site, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow limitations on implied warranties, so these limitations may not apply to you.

Dealer/Wholesale Accounts; MAP Reminder

6.1 If you access a dealer or wholesale portal, your use is also governed by your separate distributor or dealer agreement. In the event of conflict, the signed agreement controls.

6.2 Minimum Advertised Price (MAP). If you are an authorized reseller, our unilateral MAP policy applies as communicated to you separately. Site content does not grant any reseller pricing rights.

User Content; Reviews; License

7.1 If you submit reviews, photos, fitment notes, questions, or other content (“User Content”), you represent that you own or have rights to that content and that it is accurate and lawful.

7.2 You grant Founders Tires LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works from your User Content in any media for marketing, analytics, and Site operation.

7.3 We may moderate, edit, or remove User Content at our discretion.

Intellectual Property

8.1 The Site and its content, including text, graphics, logos, icons, images, video, software, and compilations, are owned by Founders Tires LLC or its licensors and are protected by intellectual property laws.

Indemnification
